The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 84 days in filing the appeal against the award, dated 18.03.2019 made in E.C.No.214 of 2014 on the file of the Commissioner for Employees Compensation (Deputy Commission of Labour), Trichy. 2.Despite receipt of notice, Respondent has/have not turned up.
3.The learned counsel appearing for the Insurance Company would submit that, in the present appeal, the challenge is confined only to the negligence/quantum of compensation and, therefore, notice to the owner of the vehicle may be dispensed with. 4.Heard the learned counsel for the petitioner and also perused the records.
