The present writ petition was filed seeking quashing of the order dated 2nd December, 2020, passed by the respondent no.1/MCD whereby the permission granted to the petitioner for running of a nursing home at the property bearing no. E-20, Panchsheel Park, New Delhi (‘subject property’) has been revoked. 2. The operative part of the aforesaid order is set out below: This is a digitally signed order. It was noted in the order passed by this Court on 19th January, 2026 that respondent no.2, who was the tenant in the subject property and was running a nursing home, has already vacated the subject property on 7th August, 2025. 4. Counsel for the petitioner submits that no fresh permission from MCD is required in the event the petitioner lets out the subject property for running of a nursing home once again. 5. Mr. Mukesh Gupta, counsel appearing on behalf of the respondent no.1/MCD and counsel appearing for the intervenor in CM APPL. 28543/2026, rebut the aforesaid submissions and submit that in the event the petitioner intends to use the subject property for running a nursing home, a fresh permission would be required. 6. At this stage, the aforesaid issue is clearly speculative as it is not clear whether the petitioner would be letting out the subject property for the purpose of running of a nursing home or not. 7. In the opinion of this Court, the entire basis on account of which the impugned order was passed, no longer exists. Hence, it is held that the operation of the impugned order no longer survives. 8.
