The challenge in the present writ petition is to the order of termination and also seeking directions to ensure payment of salary payable by the respondent nos.4 and 5 to the petitioners in accordance with the pay-scales approved by the State Government. 2. The learned Assistant Government Pleader has pointed out that the alternate remedy is available to the petitioners and the petitioners can choose to approach the College Tribunal for redressal of their grievance. She also pointed out that the order order passed by this Court on 18.10.2022 shows that it was specifically observed by this Court in the said order that the alternate remedy is indeed available and the petitioners can even now choose to approach the College Tribunal for redressal of their grievance arising from termination of their services, by exercising right of appeal under Section 81 of the Maharashtra Public Universities Act, 2016 and the liberty was granted to approach the College Tribunal. 2 WP1515-20.odt 3. Considering the same, we grant liberty to the petitioners to approach the College Tribunal and the College Tribunal shall consider the time spent while prosecuting this writ petition as this writ petition is pending since 2020. Therefore, the College Tribunal is directed to consider the aforesaid aspect if any application for condonation of delay is filed before it. 4. In view of above, the petitioners are granted liberty to approach the College Tribunal for redressal of their grievances with regard to the alleged illegal termination of their services. C.A.W. NO. 1158/2023 IN WRIT PETITION NO.4442/2021. This application is filed by the petitioners for de-tagging the present writ petition from Writ Petition No.1515 of 2020. 2. In view of reasons mentioned in the application, Writ Petition No.4442 of 2021 is de-tagged and the same be listed on 30.09.2026. CONTEMPT PETITION NO. 155/2022.
