DATE : AUGUST 28, 2026 PER COURT : 1) Heard. 2) The learned counsel for the petitioner submits that the present petition is filed seeking initiation of investigation against Respondent Nos. 4 and 6, in view of the complaints submitted by the petitioner to Respondent Nos. 2 and 3 on 05.08.2020 and 03.09.2020, in respect of his alleged illegal detention. The petitioner has also sought compensation of Rs.10,00,000/- in respect of the said alleged illegal detention. 3) The learned A.P.P., on instructions, submits that though the name of the petitioner was not mentioned Komal Kamble 2026:BHC-AUG:39763-DB 918 CRIMINAL WRIT PETITION NO. 1604 OF 2020 in the F.I.R., but upon completion of the investigation, it was found that the petitioner was involved in Crime No. 283 of 2020 registered with Nanalpeth Police Station, Parbhani. The learned A.P.P. further submits that the trial arising out of the said crime is already pending. Therefore, the petitioner has to contest the said trial. In the aforesaid circumstances, the prayers made in the present petition appear to be premature. 4) In view of the above, the present petition is disposed of, with liberty to the petitioner to take out appropriate proceedings, in accordance with law, after disposal of the criminal proceedings pending before the competent Court at Parbhani.
