Kolhe, APP for the State. Ms Rutuja V. Palaspagar, Advocate for the applicant/ respondent. CORAM: M.M. NERLIKAR, J. DATE : 25.08.2026. Heard. 2. By way of this application, the applicant/ respondent is seeking regular bail in Crime No.136/2018 registered with Channi Police Station, District Akola for the offences punishable under Sections 353, 504 and 186 of the Indian Penal Code. 3. This Court vide order dated 11-08-2026 issued non-bailable warrant against the respondent namely Deepak Ramakrishna Dabhade, pursuant to which, today he is brought before this Court and therefore, the present application is filed for seeking bail. 4. Learned Counsel for the applicant/respondent made a statement that the respondent will remain present before this Court as and when called by this Court. She further stated that now the respondent has engaged her to represent him and she is ready for final hearing of the appeal itself and therefore, he is prayed to be released on bail. 2 44.cri.apeal.507.2020 5. On the other hand, the learned APP vehemently submits that initially bailable warrant was issued, however, none appeared for the applicant/respondent. Therefore, this Court was constrained to issue non- bailable warrant which was executed and pursuant to which, the respondent is brought before this Court. The appeal could be heard however in the meantime, the applicant is prayed to be lodged in the jail. 6. I have considered the submissions of both the sides. It appears that since the beginning, the respondent did not engage any Counsel. However, since the appeal was already admitted and no one was appearing, this Court initially issued bailable warrant and since there was no appearance, this Court was constrained to issue non-bailable warrant. Therefore, the applicant/ respondent was arrested and brought before this Court. 7. Considering the fact that now the respondent has engaged the Counsel, I am inclined to grant bail. Hence, the following order : (a) The application is allowed and disposed of. (b) The applicant/respondent Deepak Ramkrishna Dabhade be released forthwith. After releasing him on bail, the applicant/respondent shall furnish P.R. bond of Rs.50,000/- with two solvent sureties in the like amount, within a period of 8 days thereafter. It is made clear that, if the respondent fails to furnish PR bond and solvent sureties, the Police officials shall again arrest him and bring 3 44.cri.apeal.507.2020 before this Court. 8. Place the appeal for final hearing on 08.09.2026. (M.M. NERLIKAR , J. ) Trupti
