That the impugned resolution No. 3(5) dated 30.08.2019 may kindly be quashed and set aside and the respondents may kindly be directed/restrained from enforcement/give effect of the impugned condition i.e. not to impose condition to deposit 10% performance 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes - 2 - guarantee on awarded amount before award of work.” 2. In terms of reply filed by respondents No.1 and 2, condition of depositing 10% of performance guarantee had been removed by the Municipal Corporation, Shimla vide resolution No. 3(15) dated 29.12.2020 from the fresh tenders keeping in view the provisions followed by the State Public Works Department in its tenders. 3. Since the relief prayed for by the petitioner has now been granted to it by the respondents, therefore, the present writ petition is disposed of as having been rendered infructuous.
