The settlement is recorded in the letter dated February 24, 2026 issued by the Deputy Superintendent of Police (Estt.) to the learned advocate for the writ petitioner. A copy of such letter dated February 24, 2026 be kept with the record. In terms of the settlement, respondent is permitted to retire voluntarily with immediate effect. Terminal benefit of the respondent shall be computed based on the pay scale drawn on March 13, 2011 being the date of his dismissal without any arrears of back wages and pension for the intervening period from March 16, 2011 until the issuance of the Pension Payment Order. All pending departmental enquiries against the respondent shall stand closed. Since the respondent was either placed under suspension or dismissed till his resignation tendered today there is an issue 2 of pay fixation. Learned advocate appearing for the writ petitioner submits on instruction that, his client will take three months time to fix the pay of the respondent till March 16, 2011. Such prayer being reasonable is allowed. Authorities will fix the pay that the respondent is entitled till March 16, 2011. Authorities will proceed to issue the Pension Payment Order to the respondent not less than three months from date and ensure that the pay receivable by the respondent is fixed till March 16, 2011 within that period of time. Needless to say that the authorities will release all terminal benefits receivable by the respondent within the period of three months from date.
