The petitioner challenges order dated 01.03.2019 passed by learned Civil Judge (Sr. Division), Balasore in a final decree proceeding being Civil Suit No. 458/1994-I (FD). Said order emanated from an application filed by the petitioner seeking to intervene in the final decree proceeding on the ground that he had purchased the property from defendant No.4 after passing of the preliminary decree. The application came to be rejected by the impugned order. 3. Mr. Mohanty, leaned counsel for the petitioner submits that in the meantime, the final decree proceeding has been concluded and an appeal has been preferred against the same being RFA No. 85/2025 in the Court of learned District Judge, Balasore. 4. Since the final decree proceeding has already been concluded it is obvious that the present application has become infructuous.
