The petitioner-husband in the marriage challenges the judgment dated 18.05.2019 passed by the learned Judge, Family Court, Jajpur in Criminal Proceeding No.50 of 2018. The said judgment has been passed U/s.127(1) of the Criminal Procedure Code (since repealed and substituted by pari materia provision contained in Section 144 of BNSS, 2023). The application U/s.127(1) of Cr.P.C. was filed in Cr.P. 145 of 2012 disposed of by judgment dated 06.08.2014 directing payment of monthly maintenance @ Rs.1,500/- to the wife in the marriage and Rs.1,000/- to the minor child born from the wedlock. The order of maintenance was enhanced by the learned Judge, Family Court, Jajpur to Rs.2,000/- for petitioner no.1(wife) and Rs.1,500/- for the petitioner no.2 (minor child). 2. The matter being listed ‘For Orders’ in the days’ list is mentioned by learned counsel Ms. Sinha for the petitioner. She files memo of date enclosing image of the written WhatsApp message from the petitioner received in her mobile number. Copy of which is enclosed with the memo. The English translation of the statement made by the petitioner in her message to her learned counsel is reproduced herein: “I Madhabi Behera, aged about 48 years, w/o- Rajendra Behera, At-Aragal Sasan, Police Station –Aul, District- Kendrapara, Present Address, C/o- Babuli Rana, At- Alakunda, Police Station- Alakunda, District-Jajpur don’t want to proceed further with the above case and hence allow me to withdraw the case for which I shall remain grateful to you and obliged.
