01. In the instant petition, petitioner herein is seeking direction upon respondents not to issue the electricity bills in the name of the petitioner after the petitioner had applied for the discontinuation of the electricity supply onwards October, 2014 against the industrial units which have been closed and destroyed in the year 2014 by devastating floods.
02. On the previous date of hearing, Mr. Shahbaz Sikander, learned AAG, was directed to report instructions. He has produced the order No. MD/KDPCL/306 of 2021 dated 20th November, 2021, in terms of which Consumer Grievance Redressal Forum has been established by Kashmir Power Distribution Corporation Limited.
03. It is stated by Mr. Shahbaz Sikander, learned AAG, that the Consumer Grievance Redressal Forum has been established by Kashmir Power Mohammad Yaseen Dar I attest to the accuracy and authenticity of this document
Distribution Corporation Limited not only at divisional level but also at sub divisional levels. Learned counsel for the respondents’ further states that petitioner has an equally, efficacious and an alternate remedy available, as such, the instant petition is not maintainable.
04. Learned counsel for the petitioner has fairly conceded to the
submissions made by the learned counsel for the respondents. He seeks withdrawal of the writ petition with a liberty to file appropriate proceedings before the Consumer Grievance Redressal Forum.
05. In view of above the writ petition is dismissed as withdrawn. However, liberty is granted to the petitioner to approach Consumer Grievance Redressal Forum for redressal of his grievances as prayed for in this petition.
