1. Mr. Ajay Gandotra, learned Senior counsel for the petitioners submits that though the respondents have filed compliance report but while rejecting the claim of the petitioners, they have mainly relied upon the Government Order dated 16.11.2018. He further submits that in view of the judgment passed by the Hon’ble Supreme Court of India in case titled, ‘UT of J&K and ors. vs. Saba Wani’ reported in 2026 INSC 439, the respondents are under obligation to consider the matter afresh.
2. Mr. Anishwar Chatterji Koul, GA submits that the respondents shall consider the claim of the petitioners in light of the judgment (supra).
3. In view of the above, the present petition is disposed of by directing the respondents to consider the claim of the petitioners in light of the directions issued by the Hon’ble Supreme Court of India.
