At the outset, learned counsel for the respondents has drawn attention of the court to the averments set out in para 2 thereof:- “2. That the answering respondents-Jal Shakti Department with due respect submits that due to certain conditions imposed by the Finance Department, Jal Shakti Department vide order dated 04-01-2019, the payment of wages to the petitioner alongwith other candidates could not be released but after seeking clarifications as well as relaxation of 12 months vouchers condition from the Finance Department, Jal Shakti Department, the respondent No.3 vide communication No.PHEP/8973-74 dated 26-03-02 had submitted the case of petitioner to the respondent No. for payment of pending wages. It is submitted that as soon as the funds are available, the pending wages of the petitioner shall be paid to him. It is submitted that presently the petitioner is getting is wages regularly since June, 2015 onwards. Copy of the order/Communications dated 04-01-2019, 14-12-2021 and 26-03- Shameem Hamid Mir 2026.04.16 10:05 I attest to the accuracy and integrity of this document 2022 are annexed herewith and marked as Annexure-I, II and III respectively.” The petition at hand is pending since 2019 and nearly seven years have gone by. None is present either on behalf of the petitioner to point out if anything actually survives in the matter. That being so, the Court is choice less but to dismiss the petition for non-prosecution.
