2. Mr. S.S. Chauhan, learned DAG with Mr. Vikash Uniyal, learned AGA, for the State of Uttarakhand.
3. The present application has been filed by the Appellant seeking special leave to appeal against the judgment and order dated 11.09.2019 passed by the court of learned Judicial Magistrate -IIIrd Haridwar in Complaint Case No.1625 of 2017, “Archana Bansal Vs. Nawab Ali” under Section 138 of the Negotiable Instrument Act, at P.S. Kotwali Jwalapur, Haridwar.
4. As per office note, the matter dates back to 22.11.2019. As per office report dated 10.02.2020, notices have been served upon the private Respondent No.2 personally and there is representation through learned counsel Mr. Devendra Singh.
5. After hearing the learned counsel for the Appellant, the present matter needs deliberation, this Court is satisfied that the Appellant has made out a prima facie case warranting
consideration. Special leave to appeal is granted.
6. The application is treated as an appeal and is admitted.
7. Heard on the delay condonation application.
8. The delay is of 05 days’ in filing the present criminal appeal.
9. This Court finds ground for condonation of the delay is
sufficient. For the reasons indicated in the delay condonation application, the same is allowed, and the delay in filing criminal appeal is hereby condoned.
10. The matter needs consideration. Let the Trial Court Record be summoned. After receipt of the same, let the paper- book be prepared and supplied to the learned counsel for the parties on the payment of usual charges.
11. List this matter on 05.05.2026.
