Sr. No. 45
IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU
(THROUGH VIRTUAL MODE)
CCP(S) No.615/2019
SANJEET KUMAR …Petitioner(s)/appellant(s) Through: None
Vs.
OVAIS AHMED, MANAGING DIRECTOR, JKSRTC.
...Respondent(s) Through: None
CORAM:
HON’BLE THE CHIEF JUSTICE
O R D E R 15-05-2026
The petitioners, vide this petition, had prayed for initiation of contempt proceedings against the respondent authorities on account of willful defiance of the order dated 12-7-2016. A bare reading of the order referred to above reveals that the petition preferred by the petitioner was disposed of by the Writ Court with a direction to respondent no.3 to consider his representation, that was allegedly pending with the authorities, for allowing him to resume his duties as driver, on the same analogy as of one Darshan Singh, Abdul Majid Dar, Inderjeet Singh ad Mushtaq Ahmad Wani was considered provided the petitioner was identical /similarly circumstanced as them. The petition at hand is pending since 2019 and nearly seven years have gone by. None is present either on behalf of the petitioner to point out if anything actually survives in the matter. That being so, the Court is choice less but to dismiss the petition for non-prosecution.
