KASIREDDY NAGASHETTY,, D/O SATYANNARAYANA, AGED 27, R/O DOOR NO. 3-56, DEVI NAGARAM, GOLLAPROLU, EAST GODAVARI DISTRICT. ...PETITIONER(S) AND STATE OF AP, rep.by its Special Public Prosecutor, (ASP, CBI, Nagpur Camp at Visakhapatnam) High Court at Amaravati. ...RESPONDENT Counsel for the Petitioner(S): P SAI SURYA TEJA Counsel for the Respondent: M.SRAVAN KUMAR,Spl.PUBLIC PROSECUTOR FOR C.B.I. 2 Dr.YLR, J Crl.R.C.No.758 of 2019 Dated 21.07.2026 The Court made the following: ORDER: The Criminal Revision Case has been filed under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for brevity, ‘the Cr.P.C.,’), challenging the order dated 15.05.2019 passed in Crl.M.P.No.417 of 2019 in C.C.No.41 of 2017 by the learned II Additional Special Judge for CBI Cases, Visakhapatnam, dismissing the discharge petition filed by the petitioner. 2. Heard the learned counsel for the petitioner and the learned Special Public Prosecutor for CBI. Perused the entire record. 3. Mr.M.Sravan Kumar, learned Special Public Prosecutor for CBI, submits that the learned Trial Court is proceeding with the trial and that, so far, the prosecution has examined P.Ws.1 and 2. He further submits that once the charges are framed, there is no question of entertaining a discharge petition. The arguments advanced by the learned Special Public Prosecutor have considerable legal force. It is well settled that once the charges are framed, there is no question of considering a discharge petition. Since the trial is already in progress, the petitioner is required to cooperate with the trial. As the charges have already been framed, this Court finds no merit in the present Criminal Revision Case. 3 Dr.YLR, J Crl.R.C.No.758 of 2019 Dated 21.07.2026 4. For the above reasons, the Criminal Revision Case is dismissed. There shall be no order as to costs. As a sequel, interlocutory applications, if any pending, shall stand closed. _________________________ Dr. Y.
