S.SYAM SUNDER RAO SC cum Spl P.P. for ACB The Court made the following: ORDER: The instant Criminal Revision Case under Sections 397 and 401 of Cr.P.C has been filed by the Petitioner / Accused seeking to set aside the Order dated 30.07.2019 in Crl.M.P.No.176 of 2019 in C.C.No.19 of 2018 on the file of the Court of Special Judge for SPE & ACB Cases-cum-II Additional District and Sessions Judge, Nellore. 2. None appeared for the Petitioner. Heard Sri S.Syam Sundara Rao, learned Special Public Prosecutor for ACB. 2 3. Since this is a Criminal Revision Case, this Court is inclined to proceed with the matter and take a decision on merits. 4. Learned Special Public Prosecutor for ACB would submit that the revision case is not maintainable as the learned Special Judge rightly dismissed the discharge petition on 30.07.2019, finding sufficient prima facie material to proceed against the Accused. At the stage of discharge, only a prima facie case is to be seen and detailed appreciation of evidence is impermissible. The order under challenge is well-reasoned, and there are no grounds to interfere with the same Hence prayed for dismissal of the revision In view of the above, it is respectfully prayed that the petition be dismissed and the proceedings be allowed to continue in accordance with law. 5. Considering the submissions made and on perusal of the material on record, this Court finds no infirmity or illegality in the order passed by the learned Special Judge. The view taken is based on prima facie assessment of the material available and does not call for interference in revisional jurisdiction. 6. Accordingly, the Criminal Revision Case is dismissed.
