The petitioner through instant petition is seeking modification of order dated 05.10.2018 whereby learned Additional District Judge, Yamunanagar in execution application has granted compensation as assessed by Reference Court instead of as assessed by this Court in RFA No.5083 of 2009. 2. Learned counsel representing the petitioner submits that Executing Court was supposed to grant compensation at par with co-sharers who have been granted compensation as per order dated 05.03.2014 passed in RFA No.5083 of 2009. The petitioner being co-sharer as per judgment of Hon’ble Supreme Court in ‘Ramphal & others v. Haryana State Industrial and Infrastructure Development Corporation Limited & others’, 2026(1) RCR (Civil) 792, was entitled to compensation as paid to others. Learned State counsel submits that State has filed SLP against order dated 05.03.2014 passed by this Court. 4. Hon’ble Supreme Court vide order dated 18.09.2015 has dismissed SLP filed against order dated 05.03.2014 of this Court, thus, order of this Court has attained finality. The petitioner is entitled to compensation at par with co-sharers. Accordingly, the respondents are hereby directed to release compensation at par with co-sharers. It is made clear that petitioner would not be entitled to interest more than paid to co- sharers. The needful would be done within three months from today. 5. Allowed in above terms. 6. Pending application(s), if any, shall also stand disposed of.
