The present petition under Article 227 of the Constitution of India is for quashing order dated 17.09.2019 (Annexure P-5) passed by learned Additional Civil Judge (Senior Division), Dasuya, whereby the application for setting aside ex parte order dated 25.10.2018, has been allowed. 2. At the outset, learned counsel for the petitioner submits that during the pendency of the present petition, the sole respondent, who was defendant before the trial Court, has unfortunately passed away and therefore, the grievance raised in the present petition does not survive. Hence, learned counsel for the petitioner prays for withdrawal of the present petition. 3. Dismissed as withdrawn.
