NIMMAGADDA REVATHI The Court made the following: ORDER: The instant Criminal Revision Case under Sections 397 and 401 of Cr.P.C has been filed by the Petitioner / Complainant seeking to set aside the dismissal order dated 28.01.2019 in C.C.SR.No.2753 of 2015, in Crime 2 No.51of 2013 on the file of the Court of Judicial First Class Magistrate, Kothapeta and to direct the Court to take cognizance of the offences against the Accused. 2. Ms.Nimmagadda Revathi, learned counsel for Respondents / Accused would submit that the revision petitioner died and filed copy of the death certificate to that effect and hence, no further orders are required in this matter. 3. It appears, the revision petitioner died and none represented him. 4. This revision case has been filed challenging the order dated 28.01.2019 in C.C.SR.No.2753 of 2015, in Crime No.51of 2013, wherein the learned Magistrate dismissed the petition observing that, except the sworn statement of the Complainant, no other independent witnesses were examined on behalf of the Complainant, which prima facie is not suffice to register a case against the Accused for the offences under Sections 420, 423, 474, 192 and 193 read with 34 of IPC and accordingly the dismissed the complaint. In that view, this Court is of the view that there are no grounds to interfere with the order passed by the learned trial Judge. 5. In that view, the Criminal Revision Case is disposed of.
