Present writ petition under Articles 226/227 of the Constitution of India has been filed for issuance of appropriate writ, order or direction especially in the nature of mandamus directing the respondent authorities to consider the case of petitioner for appointment of Constable G.D. in CAPFs, NIA and SSF and Rifleman (GD) in Assam Rifles as the petitioner has duly qualified the written examination, medical examination and have secured more than the prescribed cut off marks for the border area category being falling within the vacancies reserved for the border district, especially in view of the fact that total advertised have not been filled till date prejudicing the valuable rights of the petitioner. acer 2026.07.31 11:31 I attest to the accuracy and authenticity of this order/judgment. Learned counsel for the petitioner contends that despite being duly qualified in written examination and securing more marks than the cut off marks, the petitioner has not been selected. He, therefore, prays that the present petitions be allowed. 3. Per contra, learned counsel for the respondent contends that Directorate General, (Recruitment Branch) C.R.P.F. East Block-7, Level-4, Sector-01, R.K. Puram, New Delhi (Ministry of Home Affairs) vide letter No.A.VI-319.2015-Rectt (SSB) CT/GD-2015 dated 18.03.2026 informed that the petitioner had scored less marks than the last selected candidate in SC Category in Punjab (Border) in the Exam of Constable(GD) Exam-2015. He, therefore, prays that the present writ petitions be dismissed. 4. I have heard learned counsel for the parties and perused the whole case file with their able assistance. 5. The relevant portion of letter No.A.VI-319.2015-Rectt (SSB) CT/GD-2015 dated 18.03.2026 is reproduced as under:- “Please find enclosed herewith a copy of WPC No.11014/2019 filed by Kuldeep Singh Vs UOI and Others before the Hon'ble High Court of Punjab and Haryana at Chandigarh, for needful. 2. It is to inform that Roll No. 1402049845 Kuldeep Singh (petitioner) s/o Sukhdev Raj is a candidate of Constable (GD) Exam- 2015. He is a SC (Male) candidate from Punjab (Border) (State Code-28 and Border Code-9) and scored 45 marks. He was not selected since he had scored less marks than the last selected candidate in SC Category in Punjab (Border). The Hon'ble Court during the course of hearing on 17.02.2026 has deferred the hearing of the case to 15.07.2026 with the direction to acer 2026.07.31 11:31 I attest to the accuracy and authenticity of this order/judgment. As per MoU signed between MHA & SSC, Court cases related to notice of subject examination, conduct of CBE & preparation of merit list/result will be handled by SSC. Since, the matter is related with non selection in merit list as such subject petition is required to be defended by SSC. 4. It is, therefore, requested to examine the subject petition and defend the case by filing suitable reply before the Hon'ble High Court of Punjab and Haryana at Chandigarh at your end and progress of the case be intimated to this Directorate from time to time for needful.” 7. In view of the above, since the petitioner secured less marks than the last selected candidate, therefore, I do not find any merit in the present writ petition and the same is hereby dismissed. 8.
