1. The present writ petition has been filed for issuance of a writ in the nature of certiorari seeking quashing of the rejection letter dated 26.04.2018 (Annexure P-7), vide which application for appointment of the petitioner on compassionate ground was rejected by the respondents.
2. The present writ petition was adjourned time and again to await the decision of the challenge to Scheme for Compassionate Appointment, which was pending before Hon’ble the Supreme Court.

Learned counsel for the parties submit that Hon’ble the Supreme Court in SLP (Civil) No.11470 of 2018 titled ‘State Bank of India and others Vs. Maya Devi’, decided on 14.05.2025, has finally upheld the Scheme for Compassionate Appointment.

Learned counsel for the petitioner contends that although claim of the petitioner for compassionate appointment has been rejected but he would be entitled to payment of ex gratia (lump sum) compensation, as per letter dated 11.06.2018 (Annexure P-7A) issued by the respondents-Bank. He, therefore, prays that the petitioner be granted ex gratia (lump sum) amount, as per his entitlement.
5. Per contra, learned counsel for the respondents does not dispute the same and fairly concedes that Annexure P-7A i.e. letter dated 11.06.2018 has been issued by the respondents-Bank itself.
6. I have heard learned counsel for the parties and perused the whole file of this case with their able assistance.
7. A perusal of the file reveals that the present writ petition has been filed in the year 2019 for compassionate appointment. Undisputedly, as per the scheme, the petitioner though was not entitled to compassionate appointment for which his claim was rejected vide order dated 26.04.2018, which is impugned in the present writ petition but as per letter dated 11.09.2018 (Annexure P-7A), he would be entitled to payment of ex gratia (lump sum) compensation.

In view of the above facts and circumstances of the case, the present writ petition is disposed of with a direction to the respondents-Bank to furnish the prescribed application format along with list of documents required for processing his claim for ex gratia payment to the petitioner. On receiving of the same, the petitioner is directed to move an application along with all necessary documents for payment of ex gratia before the VIRENDRA SINGH ADHIKARI 2026.07.27 17:34 I attest to the accuracy and integrity of this document
CWP-4839-2019 (O&M) -3- respondents-Bank within a period of one month. The respondents are thereafter directed to consider and decide the same by passing a speaking
order with a period of two weeks.
