1. The prayer in the present petition under Section 482 Cr.P.C. is for quashing of the order dated 30.08.2007 (Annexure P-1) passed by the Judicial Magistrate Ist Class, Jalandhar, whereby the accused/petitioner was declared a proclaimed offender and all subsequent proceedings in case arising out of FIR No.124 dated 09.07.1999 (Annexure P-2) under Sections 379, 411 IPC, registered at Police Station Division No.3, Jalandhar. 2. On 19.07.2019, notice of motion was issued. The matter was adjourned from time to time. Today, however, none has appeared on behalf of the petitioner. 3. On 20.11.2023, the following order was passed:-
“Counsel for the petitioner submits that he has instructions to state that the petitioner would surrender within two months. He requests for deferment to produce the air tickets. KUSUM 2026.07.16 10:38 I attest to the accuracy and integrity of this document PHHC Chandigarh

4. Thereafter, on 30.11.2023, the following order was passed:-
“Counsel for the petitioner submits that petitioner is arranging for the air-tickets and will produce them on the next date. List on 18.12.2023. To be shown in the urgent cause list.”
5. Thereafter, on 18.12.2023, the following order was passed:-
“Counsel for the petitioner submits that the petitioner was on bail and faced trial till the year 2005, but did not appear before the Trial Court thereafter as the dispute was settled with the complainant. He has placed a xerox copy of air tickets on record and has submitted that the petitioner, who is settled in Canada, is travelling to India on 24.04.2024. He submits that the petitioner would surrender before the date given by this Court. List on 21.05.2024. In case, the petitioner surrender before the Trial Court on or before 30.04.2024, joins the proceedings and moves an appropriate application, the Trial Court shall dispose it of prior to the date fixed before this Court.”

Thereafter, on 27.01.2026, the following order was passed:-
“Vide order dated 18.12.2023, it was ordered that in case, the petitioner surrenders before the Trial Court on or before 30.04.2024, joins the proceedings and moves an appropriate application, the Trial Court shall dispose it of prior to the date fixed before this Court and the case was adjourned to 21.05.2024. Today, none has put in appearance on behalf of the petitioner. In the interest of justice, adjourned to 30.03.2026. KUSUM 2026.07.16 10:38 I attest to the accuracy and integrity of this document PHHC Chandigarh

7. Despite the passing of the aforementioned orders, the petitioner has not joined the proceedings. 8. In view of the above, the present petition seeking quashing of the order dated 30.08.2007 (Annexure P-1), stands dismissed. 9. All the pending miscellaneous applications, if any, stand
disposed of.
