No.3.
**** AMAN CHAUDHARY, J. (ORAL)
1.
Learned counsel for the respondents rely on the judgment passed by Hon’ble the Supreme Court in State of Himachal Pradesh and others vs. Raj Kumar and others, Civil Appeal No.9746 of 2011, decided on 20.05.2022, wherein it was observed that the broad proposition formulated in Y.V. Rangaiah vs. J. Sreenivasa Rao (1983) 3 SCC 284 does not reflect the correct constitutional position, in view of which, learned counsel for the petitioner does not press the present petition any further.
2.
Ordered accordingly.
