THE HONOURABLE SRI JUSTICE BATTU DEVANAND WRIT PETITION No.6774 of 2019 ORDER: - This Writ Petition is filed under Article 226 of the Constitution of India with following prayer for: “…pleased to issue Writ, Order or direction more particularly in nature of Writ of Mandamus declaring the action of the respondents in not considering petitioners’ claim for absorption into department however they are continuously working since 25 years and even not paying minimum time scale attached to the post held by them while regularizing the services of the similarly placed persons and paying the minimum time scale attached the posts to the individuals who are working in other wings of the T.T.D is illegal, arbitrary and violation of Article 14 of the Constitution of India and contrary to the dicta laid down by the Hon’ble Apex Court in Uma Devi’s case and consequently direct the respondents to regularize the service of the petitioners as Mazdoors in TTD Forest Wing with all consequential benefits on the ground they are working nearly 25 years in the interest of justice and pass order or orders.. [ 2. Heard Sri.M. Srinivasa Rao Madiraju, learned counsel for the petitioners and Ms.Dyumani, learned Standing Counsel for T.T.D for the respondent Nos.1 & 2 and learned Government Pleader for Endowments for the respondent No.3. 3. During hearing, learned counsel for the petitioners would submit that the matter is squarely covered by a common order passed by this Court in W.P.No.23660 of 2017 & batch, dated 06.05.2025, and hence, requests this Court to pass similar order in this petition also. The operative portion of the said common order is as follows:- 2 “5. In that view, it is apposite to dispose of these Writ Petitions, without touching the merits of the same with the following directions:- (i) Petitioners shall submit a comprehensive representation covering their pleadings supported by the relevant documents and the judicial precedents, if any, to the Executive Officer of Tirumala Tirupati Devasthanams within a period of two weeks from the date of receipt of copy of this order. (ii) The Executive Officer, in turn, shall place the same before the Board of Trustees as expeditiously as possible. (iii) The Board of Trustees shall take a decision over the matter according to governing Rules and law within a period of three months from the date of receipt of representation of the Petitioners. (iv) Depending on the decision to be taken, the Board shall forward the proposal to the Government forthwith for getting necessary approval. (v) Respondent No.3/Government is directed to consider the said proposal and take appropriate decision according to governing Rules and Law, within a period of three months therefrom.” 4. Ms.Dyumani, learned Standing Counsel for TTD would submit that Court may pass appropriate orders recording the request made by the petitioners to dispose of the present petition in line with W.P.No.23660 of 2017 and batch, seeking regularization. 5. Considering the submissions made, this Writ Petition is also disposed of in terms of the common order passed in W.P.No.23660 of 2017 & batch, dated 06.05.2025. 6. There shall be no order as to costs.
