2. Since the issue involved in all the writ petitions is one and the same, they were heard together and are being disposed of by this common order. 3.
The learned counsel appearing for the petitioner would submit that the third respondent/complainant had lodged a complaint before the State Human Rights Commission against the then Inspector of Police, namely, Siva Baskar, Papanasam Police Station, Ganesamoorthy, Peravoorani Police Station and Bharanidharan, Sub-Inspectors of Police, Thiruppananthal Police Station. However, the petitioner was not arrayed as a party in the proceedings before the State Human Rights Commission. It is further submitted that, without impleading the petitioner as a party and without affording him an opportunity of hearing, the Commission made a recommendation for taking disciplinary action against the petitioner. Therefore, the impugned order, insofar as it relates to the petitioner, is not sustainable in law, as the same has been passed in violation of the principles of natural justice. 4/7 https://www.mhc.tn.gov.in/judis

The learned counsel appearing for the third respondent has no objection to quashing the impugned order insofar as the petitioner is concerned, since no opportunity was afforded to the petitioner before passing the said order. 5. Accordingly, the order passed by the first respondent is liable to be set aside and is hereby set aside insofar as the petitioner is concerned. Accordingly, these writ petitions stand allowed.
