WAKODE, JJ. DATED : 09/09/2026 1. By this petition, the petitioner is seeking directions to the respondent Nos.1 and 2 that son of the present petitioner be appointed on the post of “Safaikar”. 2. Heard learned counsel for the petitioner, who submitted that the petitioner has joined the service as “Safaikar” in Rashtra Tukadoji Maharaj Nagpur University at Nagpur in the year 23.03.1993 and was receiving a salary. He was a regular employee. He took voluntary retirement from the Authority in December 2013 by serving an application assigning the reasons to the Authority. After the voluntary retirement, he just received an amount of Rs.2,01,969/-. After serving about 14 years, he gave an application in the name of his son Irfan, who has completed his education till 11th Std. be included as “Safaikar”, in view of the recommendation of the Lad-Page Committee. He also placed 2026:BHC-NAG:12053-DB (2) 6.wp.840.2019 reliance on the decision of this Court at Aurangabad Bench in Writ Petition No.3204/2023 [The State of Maharashtra through the Secretary and other Vs. Goroba s/o Ram Aaradwad and others dated 08.01.2025] and other connected writ petitions, by which after considering the issue involved and referring the decision of Supreme Court in the matter of Ahmednagar Mahanagar Palika Vs. Ahmednagar Mahanagar Palika Kamgar Union reported in (2022) 10 SCC 172 directions were issued. He submitted that in view of the said directions the candidature of the present petitioner for appointment of “Safaikar”, as per the recommendations of Lad-Page Committee be considered. 3. Learned counsel for the respondent No.2 submitted that if he applies fresh, in view of the directions given by this Court at Aurangabad Bench and in view of the Government Notification dated 24.02.2023 due consideration can be given to the application, with this direction, the petition can be disposed of. 4. Learned APP also supported the said contention. 5. Heard learned counsel for both parties. Perused the decision of this Court in above said writ petition, wherein this Court at Aurangabad Bench has given the directions as follows: (i) The appointments and claims to the post of Safai Kamgar shall be regulated by Government Resolution dated 24.02.2023 which shall be implemented by the Employers, Appointing Authorities or the Competent Authorities of the Establishments. (ii) The Appointing Authorities, Employers, or the Competent Authorities of the Establishments shall conduct (3) 6.wp.840.2019 objective scrutiny of individual claims of the Petitioners expeditiously in accordance with the Government Resolution dated 24.02.2023. (iii) The Petitioners or the Intervenors shall be at liberty to submit their applications before the Appointing Authorities, Employers or the Competent Authorities of the Establishments, if not submitted earlier. (iv) The Appointing Authorities, Employers, or the Competent Authorities of the Establishments shall conduct objective scrutiny of the claims and extend the opportunity to submit relevant documents to the Claimants and decide the individual claims within period of six weeks from the date of receipt of the applications. (v) In case of rejection of the claims, it shall be open to resort to the remedy as permissible in law. 6. In view of the aforesaid Government Notification, the petition is allowed by directing the petitioner to make a fresh application to the respondent No.2.
