By the present application, the applicant is seeking condonation of delay of 144 days caused in filing the first appeal, challenging the judgment and order dated 22/02/2019 passed by the learned Adhoc District Judge-2, Nagpur, in L.A.R. No. 480 of 2011 (Exhibit No.35). During the pendency of the present application, non- applicant No.1- Urmila wd/o Manohar Daware died. Her legal heirs, who are non-applicant Nos. 2 to 5 are already on record. Therefore, on oral request, leave is granted to delete the name of non-applicant No.1 from the array of non-applicants. 3 Having regard to the submissions canvassed on behalf of both sides, I have gone through the record. 4. Needless to say that, the applicant is the public body and that some time was consumed in taking steps for 2 916caf4161.2019.odt filing the appeal against the judgment and order dated 22/02/2019 passed in L.A.R. No.480 of 2011, on account of obtaining legal advice and completing the requisite formalities. The explanation offered for the delay appears to be bona fide and substantial. Therefore, the delay of 144 days caused in filing the appeal is hereby condoned. 5. The office to register First Appeal and place it for further consideration on 29/09/2026. 6.
