By the present application, the applicant is seeking condonation of delay of 397 days caused in filing the application for restoration of the appeal. 03. Considering the grounds set out in the application, the delay of 397 days caused in filing the application for restoration of the appeal, which came to be dismissed for want of prosecution for non-filing of the paper-book, vide order dated 03/07/2017, is hereby condoned. 05. The application is allowed and disposed of accordingly. Civil Application [MCA] St. No.20515/2018: Heard. 02. For the reasons set out in the application, the application for restoration of the appeal is allowed, subject to payment of costs of Rs.2,000/- (Rupees Two Thousand Only) in the account of the “Public 2026:BHC-NAG:11585 919.cao.710.19 2/2 Welfare Account” maintained by this Court with the Union Bank of India, within a period of one week from today. 03. Upon compliance with the condition of payment of costs, the appeal be registered at its original stage. First Appeal No.525/2014: The appellant shall file the private paper-book within a period of ten weeks from today, failing which the order of dismissal of the appeal shall stand restored automatically, without reference to the Court.
