For Petitioner(s): Mr.M.Guruprasad https://www.mhc.tn.gov.in/judis CRP No. 2019 of 2026 __________ Page3 of 5 ORDER The Revision Petitioner herein is the 1st defendant in the suit in O.S.No.83 of 2021 on the file of Additional District Judge, Attur, which was filed by the respondents/plaintiffs 1 and 2 for the relief of declaration and other consequential relief against the defendants 1 to 8. 2. Since the relief claimed by the Revision Petitioner is to seek only a direction for a speedy disposal, the notice to the respondents is dispensed with. 3. Before the trial court, aggrieved over the suit filed by the respondents/plaintiffs 1 and 2 in O.S.No.83 of 2021, the 1st defendant filed an application in I.A.No.2 of 2021 praying to reject the plaint stating that already there was a suit filed in O.S.No. 366 of 1997, wherein the 1st and 2nd respondents/plaintiffs were added as defendants 4 and 5, who are the purchasers of the property pending litigation and all their claim was raised before the trial court in that suit, which were not considered. Accordingly, the suit was decreed in their favour. Based on that decree, the Execution Petition in R.E.P.No.19 of 2000 was filed and delivery was also been effected in favour of revision petitioner/1st defendant, besides the findings of the trial judge in that suit in O.S.No.366 of 1997 was confirmed by the Supreme Court of India in a civil court proceedings in Civil Appeal No.9848 of 2003. Thereafter, the execution https://www.mhc.tn.gov.in/judis CRP No. 2019 of 2026 __________ Page4 of 5 proceedings was initiated and proper notice was issued. But suppressing all those facts, now the respondents/plaintiffs 1 and 2 came forward with the present suit and also sought for one of the relief to stay the operation of the decree passed in O.S.No.366 of 1997, which is a clear abuse of process of law, but the court below failed to take note of the same. Hence, he had filed an application to reject the plaint and in that suit, counter objections was also filed by the respondents/plaintiffs 1 and 2. But the trial judge is not inclined to proceed with the application filed in I.A.No.2 of 2025. 4. Considering the earlier round of application, since it went upto Supreme Court of India, the respondents/plaintiffs 1 and 2 have came forward with the present suit. Therefore, the trial judge is directed to dispose the application filed in I.A.No. 2 of 2021 in O.S.No.83 of 2021 within a period of two weeks from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is disposed of.
