For the good and valid reasons, as assigned in the instant preponement application, as well as the <No Objection= extended by learned counsel for the petitioners, the application is allowed. M/s Tanwar Security Services, M/s Oscar Security and Fire Services, and M/s Target Security & Allied Services are impleaded in the writ petition as respondents No.3 to 5, respectively. Through the present writ petition, the petitioners assail the award dated 26.10.2018 passed by the Labour Court, Ambala, whereby the reference was answered in favour of the respondent No.1 and his co- workmen, holding them entitled to reinstatement in service with continuity of service, along with 50% back wages from the date of termination, to be paid by the management within two months from the date of the award, failing which the arrears of back wages were directed to carry interest @ 9% per annum. 4. Since the impugned award was also passed in favour of co- workmen of the respondent No.1, the petitioners had challenged the same by filing CWP No.5766 of 2019 and other connected writ petitions. In the said writ petitions, the workmen waived their claim to 50% back wages along with interest @ 9%, and accordingly, a Co-ordinate Bench of this Court, vide order dated 13.02.2025, disposed of the said writ petitions by modifying the impugned award to the extent that the workmen would be entitled to reinstatement, a benefit which was already extended to them, but without any back wages or interest as awarded by the Labour Court. 5. Placing reliance on the order dated 13.02.2025, learned counsel for the petitioners submits that the present writ petition may also be disposed of in identical terms. 6. Learned counsel appearing on behalf of the respondent No.1, on instructions, submits that the respondent No.1 is also ready and willing to waive his claim to 50% back wages along with interest @ 9% per annum, as awarded by the Labour Court, and raises no objection to the DEVINDER YADAV 2026.02.11 09:55 I attest to the accuracy and authenticity of this order/judgment CWP-5775-2019 (O&M) 3 disposal of the present writ petition in terms of the order dated 13.02.2025. 7.
