(ORAL) The prayer in the present petition is for quashing of complaint No. 311 of 2015 dated 10.08.2015 under section 138 of the Negotiable Instrument Act titled as Davinder Singh Vs. Gulshan Masih, pending in the Court of Judicial Magistrate, Ist Class, Moga and proclamation order dated 10.05.2019 passed by the Learned Court of Judicial Magistrate, Ist Class, Moga, along with all consequential proceedings arising out of the same. There is no representation on behalf of the petitioner today. Learned counsel for respondent No.2-complainant contends that the petitioner was given multiple opportunities to settle the matter with the complainant as is evident from various orders passed by this Court, however, the petitioner has come forth only once but refused to make the payment in question. It is further contended that the petitioner was earlier declared as a proclaimed offender on 09.04.2018, but thereafter, he was arrested and granted bail. Subsequently, he again absconded and was declared as proclaimed offender on 10.05.2019, which is the order impugned herein.
