1. The present Petition has been filed under Section 2(b) read with Section 12 of the Contempt of Courts Act, 1971, seeking initiation of contempt proceedings against the Respondents for the alleged willful disobedience of the undertaking furnished before, and the Order dated 16.10.2017 passed by the Hon’ble Division Bench of this Court in W.P.(C) 3888/2017, titled “Sandeep Kumar v. North Delhi Municipal Corporation & Anr.”

Learned counsel appearing on behalf of the Respondent No.1/North Delhi Municipal Corporation [“NDMC”] submits that the This is a digitally signed order. impediments which had obstructed the execution of the Road Over- Bridge [“ROB”] and Road Under-Bridge [“RUB”] project on the stretch between Sultanpuri and Punjabi Basti, particularly on account of the occupation of certain portions of the subject land by private occupants, have since been substantially resolved pursuant to the disposal of a batch of Writ Petitions instituted by such occupants vide
Judgment dated 30.06.2026. He further submits that, under the said
Judgment, the occupants were granted a period of three (03) months to vacate the subject land.

Learned counsel further submits that only upon the vacation of the subject land would the Respondent be in a position to recommence the construction work, which presently remains at a standstill. He fairly submits that, at this stage, he is not in a position to furnish any definitive timeline for completion of the project.
4. This Court, however, cannot lose sight of the fact that nearly eighteen (18) years have elapsed since the commencement of the ROB/RUB project. The NDMC would, therefore, be well advised to take all necessary and expeditious steps to ensure that the construction work recommences immediately upon the land becoming available.

In view of the submissions made and having regard to the fact that the principal impediments, which had stalled the execution of the project, have now been substantially addressed, this Court is of the considered view that no useful purpose would be served by keeping the present contempt proceedings pending.

Accordingly, the present Petition is disposed of with the expectation that the NDMC shall take all necessary steps to ensure that the construction of the ROB/RUB recommences at the earliest and is thereafter carried forward with due expedition. It is, however, made clear that, in the event it is found that the Respondents have failed to take reasonable and expeditious steps towards recommencement of the construction work despite the removal of the aforesaid impediments, it shall be open to the Petitioner to seek revival of the present Contempt Petition in accordance with law.
8. The present Petition, along with all pending Application(s), stands disposed of in the aforesaid terms.
