By way of filing the instant misc. petition, a challenge has been led to the impugned FIR No.95/2019, registered with Police Station Diggi, District Tonk for the offences under Sections 279 and 304-A IPC. 2. Counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has no concern whatsoever with the alleged incident for which the impugned FIR has been registered. Hence, interference of this Court is warranted. 3. Per contra, learned Public Prosecutor, on instruction from the concerned Police Station and on the basis of the factual report received with regard to the investigation conducted so far, submits (2 of 2) [CRLMP-7205/2019] that the involvement of the petitioner has been found to be prima facie proved and the police is in process of filing charge-sheet. 4. Heard and considered the submissions made at Bar and perused the material available on record. 5. It is the settled proposition of law that if the allegations levelled in the FIR reveal the commission of a cognizable offence, the correctness of the same cannot be adjudicated by this Court under its inherent jurisdiction contained under Section 482 Cr.P.C. If at all, the petitioner has any grounds of challenge before this Court, he can take all these grounds/his defence at the appropriate stage before the Trial Court, in case, charge-sheet is submitted. In case, the charge-sheet is not submitted, he can submit a detailed representation before the Investigating Officer who shall consider the same and submit the conclusion before the Competent Court of law as per the provisions of law. 6. Accordingly, the present misc. petition stands disposed of. Stay application and all pending application(s), if any, also stand disposed of. (ANOOP KUMAR DHAND),J Ashu/3
