1. By way of filing the instant misc. petition, a challenge has been led to the impugned order dated 29.06.2019 passed by the Additional Chief Judicial Magistrate, Mahwa, District Dausa in F.I.R. No.51/2019 arising out of the F.I.R. No.101/2019 registered at Police Station Mahwa, District Dausa. Further, a prayer has been made for issuing direction to the S.H.O. of the concerned Police Station to get CCTV. footage of the place of occurrence for the purpose of conducting proper investigation.
2. It appears that similar prayer has been made by the complainant-petitioner before the Court below and the same prayer of the complainant-petitioner has already been entertained and accepted by the Court below while passing the impugned
order dated 29.06.2019 by which a direction has been issued to the concerned S.H.O. to get C.C.T.V. footage from the place where
(2 of 2) [CRLMP-6855/2019] the incident has occurred. Once such a direction has already been issued, there was no occasion or cause of action arose with the complainant-petitioner to approach this Court by way of filing the instant petition with a similar prayer to the one that has already been accepted by the Court below while passing the order impugned. Hence, this petition is not maintainable and is liable to be and is hereby rejected on this count alone.
3. However, it is expected from the Investigating Officer to submit the conclusion report of investigation as per law, after conducting thorough investigation.
4. With the aforesaid observation, the instant petition stands
disposed of.
