Paragraph Nos.3, 4 & 5 of the application read as under: “3. That the Plaintiff seeks liberty to file a fresh suit in respect of the subject matter due to if any dispute arises in future in respect of the above noted plaint. 4. That the withdrawal is voluntary and without any coercion. 5. That the present petition has been filed to secure the ends of justice and to prevent the abuse of the process of the court.” 2. In view of the above averments made in the application, the Suit is disposed of as withdrawn, along with pending application(s), if any. This is a digitally signed order.
