The dispute primarily relates to the disbursement of the terminal benefits like DCRG, FPN, GIS, GPF, RPS between the petitioner being a minor at the time of filing of the petition whose cause was espoused by the grandmother and respondent no. 5, who is said to be the second wife of the deceased employee. 3. It is agreed by the counsel for the petitioner and the counsel for respondent no. 5 that they would be satisfied if the respondents continue to pay the pension in terms of the Rules, in equal share to the petitioner and the respondent no. 5 herein. Their statement is taken on record. It is also stated by the counsel for the parties that Kartik Dhaniya, the child of the deceased employee, shall be entitled to ½ share of family pension till he attains the age of 25 years provided he remains unmarried and his monthly income from employment does not exceed Rs. 9000 plus DR. 4. We have been informed that the age of the son, Kartik Dhaniya as of today is 20 years; he is not married, nor is he earning his livelihood. They also state that on Kartik Dhaniya attains the majority, the full family pension shall be payable to respondent no. 5, but as per rules. 5. The only issue that now survives is that who should get the terminal benefits like DCRG, FPN, GIS, GPF, RPS. It is agreed by the counsel for the petitioner and the respondents that the benefits thereof be distributed in equal shares to the petitioner Kartik Dhaniya and respondent no. 5. If that be so, it is directed that the family pension be paid in equal shares between the petitioner Kartik Dhaniya and respondent no. 5. The same shall be paid within four weeks from today with adjustment of the amounts already received by respondent no. 5 in terms of the order passed by this Court. This is a digitally signed order.
