ORAL JUDGMENT : 1. Heard. Admit. Heard finally with the consent of learned counsel appearing for the parties. 2. The present application is preferred by the applicant under Section 482 of Code of Criminal Procedure for quashing of the First Information Report in connection with Crime 2026:BHC-NAG:1840-DB 2 14-J-APL-1003-2019.doc No.219/2019 registered under Sections 420 and 406 r/w Section 34 of the Indian Penal Code. 3. Heard learned counsel for the applicant who submitted that as the Investigating Officer has issued notice to his bank for freezing his account No.265010100100281 of Axis Bank and therefore, applicant apprehended that crime is registered against him. He also invited my attention to the letter issued to the Axis Bank wherein it is alleged that present applicant who is having monetary transaction with the other accused and therefore, his involvement cannot be ruled out. In fact, the name of the present applicant is not mentioned in the First Information Report. Now, the charge sheet is also filed against the other co-accused. As far as the present applicant is concerned, the Investigating Officer has sought permission to carry out investigation, if any other accused are found involved in the said crime. The crime is registered on the basis of report lodged by the non-applicant No.2 on an allegation that the co-accused namely; Harish Deoraoji Dipale, Jagdip Deoraoji Dipale and Amol Jagdish Dipale induced various investors to invest the amount and thereafter, they have collected the amount and not given any benefit on the said investment to the investors. On the basis of said report, police have registered a crime against the other co-accused. As far as present applicant is 3 14-J-APL-1003-2019.doc concerned, neither his name is mentioned in the First Information Report nor charge sheet is filed against him and therefore, it is prayed that First Information Report against the present applicant be quashed. 4. Learned APP submitted that at this stage, neither First Information Report is registered against the present applicant nor the charge sheet is filed and therefore, apprehension raised by the present applicant is not sustainable. In view of that, application deserves to be rejected. 5. In the above facts and circumstances, present application is to be disposed of with liberty to approach this Court, if the charge sheet or any other First Information Report is lodged against the present applicant. 6. With this direction, application is disposed of. 7. The bank account of the present applicant is hereby de- freezed. [JUDGE] Choulwar
