The present petition under Article 215 of the Constitution of India, read with Sections 11 and 12 of Contempt of Courts Act, 1971, seeks the following prayers: - “That in view of the aforementioned facts &circumstances, it is, therefore, respectfully prayed that this Hon'ble Court may be pleased to punish the Respondents/Contemnors for their willful, deliberate and intentional disobedience of the Order dated 10.09.2018 passed by this Hon'ble Court in W.P. (C) No.7695/2014: and pass any other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in the interest of justice.” 3. Consequentially, this petition is disposed of with direction that status quo in respect of the subject land need not be maintained. Local police is directed to ensure that no hindrance is caused, once petitioner resumes construction over the subject land.” 5. Learned counsel appearing on behalf of the petitioner fairly submits that the aforesaid directions have been complied with and in these circumstances, no further cause of action survives qua the present contempt proceedings. 6. A perusal of the record would reflect that an application under Section 340 read with Section 195(1)(B) of the CrPC has also been filed being C.M. APPL. No. 43809/2023 on behalf of the petitioner/applicant. 7. Learned counsel appearing on behalf of the petitioner submits that he does not wish to press the present petition as well as the aforesaid application, with liberty to initiate appropriate proceedings against the respondents impleaded in CM APPL. No.19519/23, i.e., (i) Zile Singh, (ii) Suresh Kumar, (iii) Anup Singh, (iv) Braham Dutt, (v) Rameshwar and (vi) Layak Ram, in case any cause of action arises in any other proceedings pending between the parties. 8. In view of the above, the present petition and the aforesaid application is disposed of as not pressed with the aforesaid liberty. 9. Pending application(s), if any, also stand disposed of.
