1 09-wp 6938.2019.odt IN THE HIGH COURT OF JUDICATURE AT BOMBAY NAGPUR BENCH, NAGPUR WRIT PETITION NO. 6938 OF 2019 ( Gajanan Raghunath Akhade and others vs. Lilabai Namdeo Salve and others ) Office Notes, Office Memorandum of Coram, appearances, Court's orders of direction, Court's or Judge's order and the Registrar's orders. Mr. A.A.Dhawas, Advocate for the petitioner/s. CORAM : ABHAY J. MANTRI J. D ATE : SEPTEMBER 23, 2024 Learned Counsel appearing for the petitioner submitted that the original plaintiff/respondent No.1 died on 23/12/2020 and the said fact is informed to him today morning. Therefore, he sought one week's time to bring her legal heirs on record. 2) The matter has been pending since 11/11/2019. By obtaining interim relief, the proceedings before the trial Court have been stayed. It seems that due to negligence on the part of the petitioners, the matter has been stayed before the trial Court and is lingering in this Court. 3) Considering the facts above, in my view, by way of last chance, one week be granted to the petitioners for bringing the legal heirs of respondent No.1 on record. If petitioners fail to take any steps within a period of one week, then the petition shall stand dismissed without further reference to the Court. 4) Stand over to 01/10/2024. ( ABHAY J. MANTRI, J. ) KOLHE Signed by: Mr. Ravikant Kolhe Designation: PA To Honourable Judge Date: 24/09/2024 18:33:08
