The instant Petition has been filed by the Petitioner under Section 278 of the Indian Succession Act, 1925, seeking the grant of a Letter of Administration in respect of the estate of Late Mrs. Kalpana Sarup, who, according to the Petitioner, died intestate on 16.04.2015. 3. It is stated that a Suit being CS(OS) No.639/2018 was filed by the Respondent herein before this Court seeking partition, possession and permanent injunction of properties forming part of the estate of Late Mrs. Kalpana Sarup. 4. It is stated that during the pendency of the proceedings, the parties were referred to the Delhi High Court Mediation and Conciliation Centre to explore the possibility of an amicable settlement. It is stated that vide Settlement Agreement dated 24.02.2026, the parties have settled the disputes. A copy of the Settlement Agreement has been handed over by the learned Counsel for the Petitioner during the course of the hearing. The same is taken on record. The Settlement Agreement is taken on record. 7. The instant Application has been signed by the Petitioner and the Respondents Nos. 2 to 5 and is accompanied by their respective affidavits. 8. The Petitioner and the Respondents No.2-5 have joined the proceedings today and state that they have read and understood the contents of the Settlement Agreement. It is made clear that any violation of the Settlement Agreement would be construed as a violation of an undertaking given to the Court. 11. The Petition is disposed of under Order XXIII Rule 3 of the CPC in terms of the Settlement Agreement dated 24.02.2026, along with pending application(s), if any. 12.
