CMP No. 13324 of 2026 By way of the present application, a prayer has been made for deletion of name of appellant No. 1, namely Smt. Rajeshwari Tyagi @ Rajesh, from the array of parties, in a decided matter, which has been decided by this Court on 03.12.2025. The application has been moved on the ground that after the decision of FAO No. 540 of 2019, Smt. Rajeshwari Tyagi has expired on 04.05.2025, leaving behind appellants No. 2 and 3 as her legal representatives. The application has been moved to update the record. In order to buttress their contentions, appellants No. 2 and 3, have placed on record the death certificate of deceased Rajeshwari Tyagi, issued by the competent authority. Since, the deceased Rajeshwari Tyagi has been succeeded by Ravinder Kumar Tyagi and Gagan Tyagi i.e. appellants No. 2 and 3 and there is no objection of the learned counsel appearing for the respondents, the application under consideration is allowed and the name of Rajeshwari Tyagi is ordered to be deleted from the array of parties. Ordered accordingly. Application stands disposed of. CMP No. 13325 of 2026 By way of present application, a prayer has been made to release the amount of compensation, awarded in favour of respondents. As per the present application, initially, there were three applicants, namely Rajeshwari Tyagi, Ravinder Kumar Tyagi and Gagan Tyagi, however, since applicant No. 1 Rajeshwari Tyagi has expired, vide order of even date, passed in CMP No. 13324 of 2026, her name has been ordered to be deleted. Considering the said fact and in view of no objection made by learned vice counsel for the non applicants, the amount of compensation is ordered to be released in favour of applications No. 2 and 3 and the same is apportioned equally amongst them, as name of applicant No. 1 has been ordered to be deleted. The
amount, so released, shall be remitted to the saving bank accounts of the applicants, particulars of which have been mentioned in para 5 of the application. The application is, thus, disposed of.
CMP No. 13326 of 2026 The application is allowed with a direction to the applicant to do the needful, as and when directed by the Court to do so. The application is, thus, disposed of. ( Virender Singh )
