At this stage, learned counsel for the petitioner submits that petitioner has also assailed the impugned re- assessment by filing appeal before Commissioner Income Tax (Appeals) and the same has not been decided due to pendency of present writ petition. It is made clear that in present petition, there is no stay against adjudication of appeal preferred by the petitioner, rather, it is expected from the Commissioner Income Tax (Appeals) to decide the petition, irrespective of pendency of present petition, as expeditiously as possible.
