CMP(M) No.659 of 2026 By way of present application filed under Order 22 Rule 3 read with Section 151 CPC and Section 5 of The Limitation Act, a prayer has been made for bringing on record the legal heirs of deceased petitioner No.1(iv) i.e. Swarn Lata. It has been averred in the application that deceased Swarn Lata has left for heavenly abode on 27.03.2025, leaving behind her husband and sons. The applicants have also placed on record the legal heirs certificate, wherein the names of the legal representatives of deceased, as mentioned in para No.3 of the application, are also mentioned. In view of the fact that the petition is pending adjudication before this Court and other legal heirs of deceased Hari Singh, who had instituted the petition are already on record, the application is allowed. The delay is condoned and abatement is set aside and the legal representatives mentioned in para No.3 of the application are ordered to be brought on record.
