Learned counsel appearing on behalf of the appellant seeks permission to withdraw the instant appeal in view of the following findings returned by the 1st Appellate Court. “However, on the basis of equity and fair play learned Trial Court ordered that the land/property received by Sh. Satish Kumar and Sh. Shyam Lal in exchange from defendant No.3 Sh. Om Parkash be returned to defendant No.3 Sh. Om Parkash and in alternative defendant No.3 was held entitled to retain only share of Sh. Satish Kumar and Sh. Shyam Lal out of total share of remaining land.” 2. Permission, as prayed for, is granted. 3. Accordingly, the appeal is dismissed as withdrawn alongwith all pending applications, if any.
