SONI SHRIVASTAVA ORAL ORDER 3 17-08-2026 In spite of repeated calls, none appears on behalf of the petitioner to press this application. Earlier also i.e. on Patna High Court MJC No.5252 of 2019(3) dt.17-08-2026 2/3 14.08.2026, none had appeared on behalf of the petitioner. However, learned counsel for the State and State Health Society are present before the Court. 2. The present application had been filed for violation of the order dated 09.05.2018 passed in C.W.J.C. No.16683 of 2017 and the operative portion of the said order is as follows: 2. Having heard learned counsel for the petitioners, learned counsel for the State as well as learned counsel for the State Health Society, this Court is of the view that it may not be necessary to discuss the details of the submissions made on behalf of the parties. By judgment dated 04.01.2018 passed in CWJC No. 19200 of 2017 (Annexure ‘F’ to the counter affidavit) the issue relating to the contract of the four petitioners of the said writ petition is pending fresh decision by the District Magistrate-cum-Chairman, District Health Society, Saran, Chapra. This Court is of the view that the ends of justice will be met if the present petitioners are granted liberty to also approach the District Magistrate-cum- Chairman, District Health Society, Saran, Chapra (Respondent No. 5) with their representation and whose cases should also be considered and decided as they claim to be L-2 and L-1 respectively, in accordance with law. 3. It is expected that an early decision will be taken in the matter considering that the petitioners’ claim arise with respect to the NIT Patna High Court MJC No.5252 of 2019(3) dt.17-08-2026 3/3 which was published as far back as in August, 2016, preferably within four weeks from the date of receipt/production of a copy of this judgment. 3. A show cause has been filed on behalf of opposite party nos.4, 5 and 6 and in paragraph-7 whereof, it has been specifically stated that the tender notice was published on 14.04.2016 for a contract period of three years, which had expired in the year 2019. The tender document for appointing outsourcing agencies in the Sadar Hospital has been received in the office of the District Health Society, Saran and the District Health Society in its meeting dated 01.06.2019 had decided to start the process for floating fresh tender notice, which fact is evident from the minutes of the meeting, which is Annexure-D to the show cause. 4. Upon consideration of paragraph-7 and Annexure- D to show cause, in my considered view, no useful purpose would be served in keeping this application pending, hence this application is dismissed as infructuous.
