Applicants have filed the instant application with the prayer for restraining the respondents from convening Departmental Promotion Committee or making promotions to the post of Superintendent Grade-II, from the Feeder Category of Senior Assistants.

Upon issuance of notice on this application on 23.04.2022, the State Authorities have filed the Reply-Affidavit with the specific averment in Para 6 that the petitioner have not completed requisite 7 years of service, so as to make them eligible for promotion to the post in question.

The instant application for stay was filed on 30.05.2019. Since the filing of the application, the petitioners have not pressed their prayer for interim after receipt of reply, therefore, the prayer for interim has lost its efficacy, in view of the fact that the matter is already on the hearing board.

In these circumstances, the application is disposed off, as not pressed.

However, it is made clear that the promotions shall be subject to the final outcome of the instant petition.

Roshan Lal and 15 others have filed the instant application under Section 151 read with Order 1, Rule 10 of CPC seeking their impleadment as party respondents in the instant petition, on the ground that the claim of the petitioners for including them in the promotional hierarchy shall adversely affect the rights of the applicant.

Upon listing of the instant application,
Learned Counsel for the non-applicants-
petitioners, does not oppose the prayer for impleadment.

Taking into account the entirety of the
facts and circumstances, coupled with the fact that the rights of the parties including the assertion and counter assertion are yet to be adjudicated at the time of final hearing, therefore, no prejudice shall be caused to the petitioners/non-applicants, in case the present application is allowed.

Accordingly, the instant application is allowed and Roshan Lal and 15 others are impleaded as party respondents and shall figure as respondents No.4 to 19 in the petition.
Application stands disposed of.
