The present Writ petition is filed for the following reliefs:- “for directing the respondents for considering the application of the petitioner and others which was filed against the dealer of the Public Distribution System within the Gram Panchayat, Murtiya who is the chotelal Sah, he has been defalcated the ration which has supplied by the respon dents for distribution among the consumer but did not distributed and taken higher Patna High Court CWJC No.20486 of 2019 dt.22-06-2026 2/3 money from his consumer for which petitioner filed several application before the respondent but respondent authority has not been considered said application as yet and further give other legal consequential benefit to the petitioner.” 2. It is the case of the petitioner that he, along with several other persons, has suffered on account of the improper distribution of ration to the consumers. Being aggrieved by the same, they filed an application before the District Magistrate, East Champaran, Motihari; the Sub-Divisional Officer, Raxaul; and the Block Supply Officer, Adapur, on 26.06.2019. In spite of the same, the respondent-authorities have remained silent and have not passed any order thereon. 3. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents. 4. On perusal of the record, it transpires that no counter affidavit has been filed in this case. It is also evident that there is no impugned order under challenge and that the writ petition has been filed merely seeking a direction to the concerned Patna High Court CWJC No.20486 of 2019 dt.22-06-2026 3/3 District Magistrate to pass an appropriate order on the aforesaid application. 5. Taking into consideration that the petitioner along with others are being aggrieved by the acts of the PDS dealer, who is alleged to have misappropriated the ration meant for distribution, this Court deems it appropriate to direct the concerned District Magistrate to consider the petitioner's application, conduct a proper enquiry into the matter, and pass an appropriate order in accordance with law within a period of two months from the date of receipt of a copy of this order. 6. With the above said observation, the Writ petition is disposed of. 7. Interlocutory Application(s), if any, shall stand disposed of. Shanu/- (G.
