2. The learned counsel for the opposite party-State submits that in compliance of order dated 02.05.2018 passed in C.W.J.C. No. 6845 of 2016, departmental proceeding was initiated afresh wherein sufficient opportunities were given to
Patna High Court MJC No.690 of 2019(5) dt.07-04-2026 2/2 the petitioner to appear in the proceeding, but he did not appear and participate in the departmental proceeding. Based on the documents and evidences, the disciplinary authority i.e. the District Education Officer, Purnea vide his Memo No. 748 dated 02.03.2019 proceeded to pass order of punishment under Rule 14(11) of the CCA Rules, 2005 and the petitioner has been dismissed from service.
3. After going through the documents on record and Memo No. 748 dated 02.03.2019, this Court is satisfied that the
order under contempt i.e. order dated 02.05.2018 passed in C.W.J.C. No. 6845 of 2016 has been complied by the opposite parties.
4. Accordingly, the contempt petition is dismissed with a liberty to the petitioner to assail the order contained in Memo No. 748 dated 02.03.2019 passed by the District Education Officer, Purnea, if so aggrieved.
