Page No.# 2/2 This application, under Order XLI Rule 27 of the Code of Civil Procedure, is preferred by the applicant for allowing him to adduce additional evidence. Mr. Singh submits that pursuant to the deed of sale dated 15.03.2012, the applicant herein is the owner of the suit property and the said deed of sale could not be exhibited during the course of trial and as such, this application is filed for allowing him to adduce the said deed of sale as secondary evidence. Though vide order dated 04.06.2026, Mr. Mazumdar, learned counsel for the opposite party was directed to produce the original deed of sale, which according to him was with the opposite party herein, today submits that the document is not available with the opposite party. However, he submits that he has no objection in the event of allowing this application and to produce the deed of sale dated 15.03.2012 before this Court. In view of the submission of learned counsel for both the parties and also considering the facts and circumstances on the record, this I.A. stands disposed of allowing the applicant to adduce the deed of sale as additional evidence before this Court.
