Goswami, learned counsel for the applicant. Also heard Ms. T. Pathak, learned counsel for the injured namely, Sanjeev Bardhan. 2. This application under Order 1 Rule 10 (2) of the Code of Civil Procedure has been filed for impleading the injured person, namely, Sanjeev Bardhan in the connected MAC Appeal No. 123/2017. 2. Learned counsel for the appellant has submitted that the appellant have filed the connected MAC Appeal No. 123/2017 impugning the judgment and award dated 05.06.2014 passed by the Motor Accident Claims Tribunal, Sonitpur, whereby the appellant was directed to pay a compensation amount of Rs. 19,45,000/- to the claimant. He submits that though the claim case was filed for claimaning compensation in respect of injuries sustained by Sanjeev Bardhan, however, it was filed by his father late Tapan Ch. Bardhan on his behalf. He submits that during the pendency of the appeal has already expired hence, an application has been made by the Insurance Company to impleade the injured person namely Sanjeev Bardhan in the connected appeal. He also submits that in the meanwhile the parties have also reached an amicable settlement. 3. Learned counsel for Sanjeev Bardan does not oppose the prayer. Hence the prayer is allowed. 4. This Interlocutory Application is accordingly disposed of with a direction that the injured Sanjeev Bardan may be implead as respondent No. 1(1) in the connected MAC Appeal No. 123/2017. Page No.# 3/3 5. The appellant shall file an amended cause title showing the name of the newly impleaded respondent in the same. 6. Let the connected appeal be listed on 27.04.2026.
